Things Get Nasty in the Coldplay Plagiarism Case

I have a lot of love & respect for Coldplay, but even I think this is a low blow.  The band refutes the claims that it stole the melody for Viva la Vida from a Joe Satriani song.  Now in court papers, courtesy of E! Online, Coldplay gives the reason that they did not plagiarize as, "guitarist's song 'lacks originality' and therefore was in no position to receive copyright protection."

Ouch!

Coldplay insists any similarities between the songs are coincidental.

I think Coldplay will lose.  If George Harrison can be found guilty for subconscious plagiarism for My Sweet Lord (saying he stole from the Chiffon's He's So Fine) then Coldplay is toast.
